BNSF Claims Amtrak Train Crash Victims Can’t Sue
(Mendon, MO) — BNSF Railway is arguing that the victims of a deadly Amtrak crash in northern Missouri this summer aren’t allowed to sue. The Texas-based freight railroad filed a lawsuit this week in federal court claiming the victims can’t sue because they checked a required box acknowledging a set of terms and conditions when buying tickets. BNSF is seeking a preliminary injunction that forces the victims to arbitrate with the railroad. Several people were killed and dozens more were injured in the train derailment near Mendon in June.
