Rep. Adam Niemerg: Federal injunction on Gov. Pritzker’s weapons ban protects honest citizens while court challenges move forward
Dieterich, IL – State Rep. Adam Niemerg (R-Dietrich) says a federal court injunction on Governor JB Pritzker’s weapons ban is welcome news for honest firearms owners wondering how this new law affects them.
“There has been a lot of confusion out there about this new law,” Niemerg said. “The injunction applies statewide and holds honest citizens harmless until the courts provide a definitive answer on the constitutionality of this new law. This is a big win for the 2nd Amendment.”
Judge Stephen P. McGlynn’s placed an injunction on the enforcement of the so-called Protect Illinois Communities Act because the law will likely by ruled unconstitutional.
“There is no question that Plaintiffs are harmed by PICA and will continue to be harmed if this Court denies the motion for preliminary injunction,” Judge McGlynn wrote in his opinion. “A constitutional right is at stake. Some Plaintiffs cannot purchase their firearm of choice, nor can they exercise their right to self-defense in the manner they choose. They are bound by the State’s limitations. Moreover, other Plaintiffs cannot sell their inventory, even to residents of other states that do not ban the ‘arms’ identified in PICA.”
Niemerg said if the Legislature wants to get serious about stopping violent crime, there needs to be a focus on criminals not on stripping away the rights of honest citizens.
“We are often lectured by the far left about how we never ‘do anything’ to address gun crimes but the truth is we do keep passing laws, but these laws simply don’t work,” Niemerg said. “The Legislature approved a red flag law shortly after the Aurora shooting. That law was supposed to stop incidents like the one in Highland Park, but it didn’t. Not only is this latest gun law going to be equally as ineffective as past gun laws, but it also is on its face unconstitutional. When the courts finally do render this law unconstitutional, we will essentially be back at square one. We will have done nothing to secure schools. We will have done nothing to increase funding for law enforcement. We will have done nothing to ensure people who use guns to commit crimes are punished to the full extent of the law. All the far-left gun grabbers will have accomplished is cost honest citizens thousands of dollars to defend their constitutional rights. The ‘do nothing’ politicians are the ones who think the best way to stop violent crime is to attack the constitutional rights of honest citizens.”
